Malaysia Calls for Intellectual Property to Be Recognised as a Bankable Asset

A proposal that could change how creative and technology businesses raise money has been put forward. Bernama reports, under the Ministry of Communications, that Malaysia is calling for intellectual property to be recognised as a bankable asset. I have only seen the headline, so I do not know the forum where the call was made or the specific mechanisms proposed.

Intellectual property, or IP, includes copyrights, patents, trademarks and designs. A bankable asset is one that a bank or financier will accept as security or value when lending money. At present, many lenders prefer tangible assets such as property or equipment, which makes it difficult for creative companies and start-ups, whose main assets are ideas, content and brands, to obtain financing.

Recognising IP as bankable would require ways to value it reliably, register and protect it and enforce rights if a loan is not repaid. Some countries have experimented with IP-backed financing, but valuation remains difficult, since the worth of a film catalogue or a software patent can change rapidly. Legal frameworks, credit guarantees and trusted valuation methods would be important.

The call fits with the government's emphasis on the creative industry and on moving up the value chain, and with Malaysia's discussions with Indonesia, Singapore and Cambodia on creative cooperation. For creators and small companies, the key step is to protect their work through registration and clear contracts. If financing options develop, those with well-documented IP will be better placed. Watch for any proposals from the intellectual property agency, banks and the central bank, and for pilot schemes that test how IP can be used in lending.

Fahmi's Indonesia Visit Paves the Way for Wider Creative Cooperation; Malaysia Seeks Creative Industry MoUs With Indonesia, Singapore and Cambodia

Malaysia's communications minister has returned from Indonesia with an agenda for regional creative cooperation. Bernama reports that Fahmi Fadzil's Indonesia visit has paved the way for wider creative cooperation beyond screen and stage, and a separate report says that Malaysia is seeking creative industry memoranda of understanding with Indonesia, Singapore and Cambodia. Earlier this week, Malaysia also proposed a high-level committee with Indonesia to accelerate cooperation in the sector.

The creative industry includes film, television, music, animation, games, publishing and digital content. Cooperation between neighbouring countries can mean co-productions, shared marketing, training exchanges and joint efforts to protect intellectual property. Indonesia has a very large audience and a vibrant content industry, while Singapore and Cambodia offer different markets and skills.

I have only seen the headlines, so I do not know the content of the MoUs or the timetable. Memoranda of understanding are usually statements of intent, and the practical results depend on follow-up, funding and the involvement of companies and artists. Indonesia has also proposed working with Malaysia on international recognition for Malay heritage including the Jawi script.

For artists and producers, the proposals could open new opportunities, such as access to festivals, co-production funds and distribution platforms. For audiences, they may bring more regional content on streaming services and in cinemas. To benefit, creators can join industry associations, follow announcements from agencies and prepare projects that suit co-production formats. Watch for the signing of MoUs, the formation of the high-level committee and any new funding schemes. Cultural cooperation works best when it respects the contributions of each country.
